TERMS AND CONDITIONS OF CONTRACT.

GENERAL TERMS

This document sets out the terms and conditions for contracting products from the TERRA I XUFA online shop (https://terraixufa.com/tienda), owned by TERRA I XUFA, S.L.

The full and unreserved acceptance of these conditions is necessary for the purchase of products from the online shop, as well as the acceptance of the rest of the terms and conditions contained in our Privacy Policy and Legal Notice. Such agreements and conditions make up the “Contract” between the user/client and TERRA I XUFA S.L. and shall govern the commercial relationship between the two. TERRA I XUFA S.L. reserves the right to modify and update its content, terms and conditions of the contract, as well as its Privacy Policy, and the user must therefore ensure that these terms and conditions are the last ones published.

The user/client, hereinafter the buyer, in order to contract must be of legal age and be in full exercise of his powers to contract in accordance with Spanish law.
The online shop only delivers to Spain, excluding the Canary Islands, Ceuta and Melilla, hereinafter the territory. If the user/customer is outside the “territory”, he/she must contact our export department by e-mail (info@terraixufa.com) or by telephone at: +34 963733944

PURCHASE AND PAYMENT METHOD

a) Product selection:

After accessing the online shop, the user must select the products he or she wishes to purchase, a selection that will be reflected in the shopping cart. Each of the products has a description, the unit price of the product with the applicable taxes and the product quantity. The final price of the purchase, when selecting the product, will be increased by the shipping costs. However, depending on where the order is to be sent and the quantity finally purchased, the costs may vary and this variation will be informed at the final stage of the contract, but always prior to payment. Likewise, the prices of the products will be updated at all times, unless there is a manifest error in the price, in which case TERRA I XUFA S.L. will contact the consumer who accepts the correct price of the product or offer him/her the cancellation of the order and a refund of the amount paid.

Once the products have been selected, the user/customer must go to the shopping cart and check that the selection matches his/her order.

Before finishing the purchase, you must register by providing the data on the form. The sections indicated with an asterisk are compulsory and the rest of the fields are optional. The compulsory fields are necessary to carry out the purchase and your refusal to supply them will prevent the order from being processed. Likewise, you must accept the Privacy Policy and the rest of the terms and conditions. The personal data and other information required to place the order must be true and updated, otherwise the buyer assumes the responsibility of providing incomplete or false information.

b) Payment methods:

The online shop offers the following means of payment:

1. Credit cards: By using a virtual POS provided by TRIODOS BANK. Accepts credit and debit cards from Visa, Matercard, American Espress.
2. Bank transfer: An e-mail is sent to the user/customer indicating the account number to which the transfer of the purchase amount must be made.

3. Bizum: A telephone number linked to our bank account is provided.

All forms of payment are made through secure platforms that use security measures and protocols that guarantee the confidentiality of the transactions. The payment information entered on the form will be processed directly by the service providers. TERRA I XUFA S.L. does not have access to it.

Once all the data has been entered, and the purchase verified by the user, the latter will receive an e-mail confirming the order with a summary of the transaction (products purchased, price and approximate delivery times). Once the purchase has been made, if TERRA I XUFA does not have one or more of the products purchased, the customer will be informed of this fact directly by e-mail so that they can replace the products or cancel the order.

In the event that charges are made to your card without your intervention, you will be entitled to an immediate refund of the charge. However, TERRA I XUFA, S.L. may request justification of the loss, theft, loss or blocking of the card in order to accredit the fraudulent charge.

DELIVERY TIMES AND EXPENSES

Once the payment has been verified, TERRA I XUFA, S.L. will deliver the order within a period of no more than 72 working hours (for deliveries within the territory) calculated from the day after receiving the payment, without taking into account Saturdays, Sundays and holidays. The costs will be included in the price and will be calculated during the contracting process.

RETURN POLICY

a) Right to withdraw from the contract:

Provided that the purchaser is a final consumer, he shall have the right to withdraw from the contract within a period not exceeding 14 calendar days from receipt of the order. The withdrawal may be communicated to TERRA I XUFA, S.L. by the following means:

Once you have communicated your wish to cancel the purchase, you must send the order in its original packaging, as it is a food product, and at your own expense, to the following address:

TERRA I XUFA S.L., after checking that the order is in perfect condition and in its original packaging will proceed to refund the amount paid by the customer (not including return costs which will be borne by the buyer) within a period not exceeding 14 calendar days from receipt of the order.

b) Refunds for changes or incidents in the order:

In the event of a discrepancy between what has been purchased and what has been sent, TERRA I XUFA S.L. will assume the costs necessary to replace the product sent by mistake with the correct one. To this end, you must notify TERRA I XUFA S.L. of the error in the shipment within a period of no more than 14 calendar days from receipt of the order by the following means:

Once the incident has been received, TERRA I XUFA S.L. will contact the buyer to arrange for the withdrawal of the product and its replacement by the product actually purchased.

TERRA I XUFA’S RESPONSIBILITY

TERRA I XUFA S.L. will not be responsible for products sold that have been partially consumed or improperly stored by the buyer before consumption.

The photographs and/or images of the products that appear published in the online shop are to illustrate the customer and identify our products. There may be slight differences between the images and photographs on the website with the reality of the product (different shades, different presentation, etc.). TERRA I XUFA S.L. is not responsible for these small differences and, unless the product is substantially different from the one purchased, your request will not be dealt with for this reason.

TERRA I XUFA S.L. will not be responsible for the non-fulfilment of the contract when this non-fulfilment is caused by fire, strike, fortuitous case, force majeure. Neither shall it be liable for non-compliance by third parties (payment gateways, information society service providers, etc.) and, in short, by those third parties which are not suppliers of TERRA I XUFA S.L.

In spite of acting with diligence, TERRA I XUFA S.L. cannot avoid on occasions the interruption of the services it provides through the website for reasons of maintenance, updating, security or external causes, nor can it guarantee the supply and availability of all its products at all times. Likewise, behind the online shop there is a team of people who can make mistakes that we try to correct as soon as possible. None of the above-mentioned reasons can give rise to a claim for damages, direct or indirect.

JURISDICTION AND APPLICABLE LAW.

The terms and conditions of the contract shall be governed by Spanish law. Any dispute that may arise between the buyer and the seller in relation to the interpretation and/or execution of the contract will be resolved before the judges and courts of the consumer’s domicile.
